Welcome to Aquamints, operated by Aquamintarts Labs Inc, a company incorporated and operating under the laws of Australia. By accessing or using the Aquamints platform at www.aquamintarts.com, you agree to be legally bound by these Terms of Service.

These Terms constitute a legally binding agreement between you and Aquamintarts Labs Inc. If you do not agree to these Terms in their entirety, you must not access or use the platform.

To use the Aquamints platform, you must:

You are solely responsible for maintaining the confidentiality of your account credentials including your username, password and seed phrase. You agree to notify us immediately of any unauthorized use of your account.

Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform at our sole discretion.

Minting NFTs

When you mint an NFT on Aquamints, you represent and warrant that:

• You are the original creator of the content or have obtained all necessary rights and permissions
• The content does not infringe any third-party intellectual property rights
• The content does not contain illegal, harmful or offensive material
• You have the right to sell and transfer ownership of the NFT

Content Review

All NFTs submitted to the platform are subject to review and approval by our moderation team before being listed publicly. We reserve the right to reject any content that violates our guidelines or these Terms without prior notice.

Ownership & Transfer

When an NFT is purchased through the platform, ownership is transferred to the buyer. The platform records and facilitates this transfer but does not guarantee any specific rights beyond what is explicitly stated by the creator at the time of listing.

Deposits

Users may deposit Ethereum (ETH) into their platform wallet by sending funds to the designated wallet address and submitting proof of payment. Deposits are credited upon verification and admin approval.

Gas Fees

A gas fee is charged for minting NFTs on the platform. This fee is deducted from your wallet balance at the time of minting. Gas fees are non-refundable.

Bidding

When you place a bid, the bid amount is deducted from your balance immediately. If your bid is declined, funds will be reviewed for return in accordance with platform policy. All bid approvals are subject to admin review.

Withdrawals

Withdrawal requests are subject to admin approval and processing time. We reserve the right to delay or deny withdrawals if we suspect fraudulent activity or if your account is under review.

You agree not to engage in any of the following activities:

• Uploading content you do not own or have rights to
• Engaging in wash trading, price manipulation or artificial inflation of NFT values
• Creating fake accounts or impersonating other users
• Using the platform for money laundering or other illegal financial activities
• Attempting to hack, exploit or disrupt the platform or its infrastructure
• Uploading malicious code, viruses or harmful software
• Harassing, threatening or abusing other users
• Circumventing platform fees or payment processes
• Scraping, crawling or data-mining the platform without written consent
• Using the platform in any jurisdiction where NFT trading is prohibited by law

Violation of these prohibitions may result in immediate account suspension, legal action and reporting to relevant authorities.

Platform Ownership

The Aquamints platform, including its design, code, features and branding, is the exclusive property of Aquamintarts Labs Inc. All rights are reserved. You may not copy, reproduce or distribute any part of the platform without written permission.

User Content

You retain ownership of the content you upload to the platform. By uploading content, you grant Aquamints a non-exclusive, royalty-free, worldwide license to display, promote and facilitate the sale of your content on the platform.

Reporting Infringement

If you believe your intellectual property rights have been violated on the platform, please contact us at legal@aquamintarts.com with full details of the alleged infringement.

The Aquamints platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

• We do not guarantee the value, authenticity or future performance of any NFT listed on the platform
• We are not responsible for losses arising from market volatility in cryptocurrency or NFT values
• We are not liable for any indirect, incidental, special or consequential damages arising from your use of the platform
• We do not guarantee uninterrupted or error-free operation of the platform
